North Carolina is a top producer of tobacco, sweet potatoes and other fruits and vegetables ? but in the near future, farmers might not have enough workers to pick them.

Across the nation, the number of seasonal agricultural workers is shrinking, costing billions. That?s largely the result of a diminishing number of migrant workers coming from Mexico.

So far, North Carolina?s farmers say they aren?t experiencing a significant shortage. But harvest season has yet to peak in the state, so it?s difficult to tell whether the state will experience a lack of labor, said Larry Wooten, president of the N.C. Farm Bureau.

North Carolina has a strong guest worker visa program, and its immigration laws are not as strict as some nearby states.

The labor shortage is affecting each state differently, said Kristi Boswell, labor and immigration congressional relations director for the American Farm Bureau Federation in Washington.

?If they don?t feel it yet, the likelihood of them feeling it soon is probably high,? Boswell said.

A significant labor shortage could have a considerable impact on the North Carolina economy, which draws more than $70 billion ? about 20 percent of the state?s income ? from agriculture. And because the state is a leading producer of numerous crops, a shortage would affect local and national produce costs. The Farm Bureau Federation recently projected that national agricultural labor shortages will cost $5 billion to $9 billion in annual losses.

?If we don?t have an adequate supply of labor, the crops are going to rot in the fields,? said N.C. Agriculture Commissioner Steve Troxler. ?And eventually it?s going to affect prices.?

North Carolina relies on about 90,000 migrant farm workers, said Lee Wicker, deputy director of the N.C. Growers Association. Wicker, who farms tobacco in Lee County, estimates that about 60,000 of those workers are in the country illegally.

Thousands of North Carolina residents are jobless, with a statewide unemployment rate of more than 9 percent, according to the state Department of Commerce. But some farmers say most Americans are unwilling to take farm jobs that require hard labor under a blazing sun for little pay.

Tony Ross, who grows several crops in Moore County, said Americans might take jobs operating tractors or other heavy machinery, but they often avoid jobs that involve manual labor.

?They shun this for the most part,? he said.

The growers association, which helps farmers hire migrant guest workers, is required to first market its jobs to Americans. The agency posted 7,500 jobs this year, and about 350 Americans applied. But an overwhelming number of them quit after several days in the fields, Wicker said.

?Our growers want to hire U.S. workers, but they?re scared that when we get to the hard work, everyone quits,? he said.

The Farm Bureau Federation estimates that illegal immigrants account for between 50 percent and 70 percent of all farm workers in the United States, on top of migrants who are working in the United States legally.

The number of people immigrating to the United States from Mexico is now almost equal to those immigrating to Mexico from the United States, according to a Pew Hispanic Center study. The slowdown is possibly a result of a crackdown on illegal immigration in the United States, increased violence along the border and a growing job market in Mexico.

An upturn in the United States? economy could further draw migrant laborers away from farm work and toward other job sectors with better working conditions and higher wages, such as construction, said Blake Brown, a professor and extension economist at North Carolina State University.

?[Farm] labor is going to be scarce relative to the demand if we see a rebound in construction in the future,? Brown said.

An ?adequate supply?

Although most North Carolina farmers are able to find an ?adequate supply? of labor, farmer Billy Carter said he does not think they are able to secure as many workers as they would like. Carter grows more than 1,000 acres of tobacco, watermelons, tomatoes and other crops in Eagle Springs, a community in Moore County.

Green card and illegal migrant workers typically travel up the East Coast along Interstate 95, stopping in several states for seasonal work throughout the year. This ?migrant stream? has all but evaporated in the past few years, Wicker said.

Also, some North Carolina farmers wrongly anticipated that they would see an influx of migrant workers avoiding Alabama and Georgia because of tough anti-illegal immigration laws in those states that require immigrants to carry identification documents at all times, as well as requiring employers to electronically verify the legal status of their employees.

Last year, Hurricane Irene destroyed a significant portion of the tobacco plants in the eastern part of North Carolina, so farmers expected to have a surplus of labor to harvest other crops. Reliable labor

The H-2a visa program, which brings migrant workers to the United States on seasonal work visas, is expensive ? about $1,000 per worker on top of a guaranteed $9.70 per hour wage, housing and transportation. It also requires a hefty amount of paperwork. But farmers say it is worth it to have a reliable labor force. Many of North Carolina?s signature crops that require hard manual labor ? such as tobacco and sweet potatoes ? are time sensitive.

?There?s one thing that?s more expensive than the H-2a program, and that?s having a beautiful crop ready to harvest and no one to pick it,? Wicker said.

The visa program is more successful in North Carolina than other states because of the growers association, which manages the paperwork, transportation and training for about 7,000 of the state?s H-2a workers, easing the farmers? burden. Wicker said the number of members has been continuously increasing, especially in the last couple of years.

Cruz Dias of San Luis Portosi, Mexico, exemplifies the H-2a program. He has worked six months a year at Ross? tobacco farm for 23 years. With the money he has earned, he was able to send his three children to college in Mexico.

?I work in Mexico a little bit, not too much,? Dias said. ?The work here is all I need. ... It?s pretty good for money, for school, for food.?

?Survivors?

With the looming labor shortage, the agriculture industry is looking for ways to weather the storm.

Many farmers are switching to mechanized harvesting for crops that do not necessarily require manual labor, such as tobacco, Brown said. Additionally, North Carolina is third in the nation for crop diversity. A wide array of crop possibilities allows farmers to pick and choose what they grow, based on consumer demand as well as labor constraints.

?Farmers are survivors,? Wicker said, noting that farmers might abandon a crop if there is not enough manual labor available to sustain it.

The mandatory E-Verify system has been a ?game changer? in agriculture because many farmers have no choice but to rely on illegal labor, so there is an incentive for farmers to hire under the table, Wooten said. He noted that the business community in North Carolina would oppose strict immigration laws like those in Alabama, Georgia and Arizona because it would expedite the labor shortage and hurt the state economy.

The government should make the reforms and reduce regulations instead of asking farmers to make changes to their farms that could cost them crops and profit, Boswell said.

?It should come from a federal level,? she said. ?There should be reform instead of leaving growers to solve it on their own.?

You Can Bet on These Two Clear Trends

One of the great growth global trends going on in the world is the growth in air traffic. And there is any easy way to play it, without owning an airline?

I was in Mongolia most recently. The airport in Ulaanbaatar is small, but growing. There has been much talk about building a new airport some distance away. The current one suffers from high winds and a short runway unsuitable for 747s and larger aircraft.

Whether that gets done or not, it?s clear air traffic is pushing up against capacity. Year-over-year air traffic, including airfreight, is up 30% from a year ago. And if you look at a longer-term trend going back to 2006, you see air transport had nearly doubled through 2011.

In short, it?s booming.

But what?s particularly interesting about this story is that it is not all that unique.

Air traffic globally is on the rise ? with most of the growth coming from Asia and the emerging markets. Passenger traffic grew nearly 6% overall last year. Most industry forecasts expect it will double in the next 20 years.

The key investment angle here is that the airlines increasingly do not own the planes. They are leasing them.

Leasing was practically nonexistent in 1970, but has since surged. Now nearly 40% of aircraft are leased. A sizable industry of airline leasing companies now exists to purchase aircraft and lease them to airlines.

Just a week ago, Intl. Lease Finance Corp. ? which is a subsidiary of AIG ? announced the delivery of a Boeing 737 to Eznis Airways, which is Mongolia?s largest privately owned airline. (Aero Mongolia is the other private airline. Mongolian Airlines (MIAT) is the state-owned airline.)

Why is leasing so popular?

One reason is that airline leasing companies can get better financing deals than the airlines. (For some airlines, leasing gives them access to aircraft they wouldn?t get otherwise.) The airline business is a very up-and-down business, as you know. As a result, it?s expensive to borrow money. But an airline leasing company with a good balance sheet can borrow at much more attractive rates. An airline leasing company can also spread out its risks among different airlines and markets. So its earnings are far less volatile.

For an airline leasing company, it can also redeploy a plane. If, for example, an airline doesn?t need a leased plane, it can get out of the lease by working with the airline leasing company. The airline leasing company gets some financial consideration. And such deals are contingent on the leasing company finding a new lease. But at the end of the day, the whole thing works more smoothly than if the airline owned the plane outright.

An aircraft is kind of like real estate. It is something that is durable and tends to holds its value. An aircraft typically has a life that exceeds 30 years. (Most of the time, we don?t fly them that long.) You can sell an aircraft with a phone call, much like commercial real estate. There is a ready pool of buyers. As with retail space or an apartment, a leasing company can find other ?tenants.? The cost of operating the aircraft falls to the airline, or the tenant. This includes maintenance and insurance.

As with real estate, lease terms are for a number of years (three-12 being common). The lease is paid monthly in advance. There are security deposits, which provide protection for the ?landlord.?

Leasing companies, in a way, are like REITs with wings. REITs are real estate investment trusts that pay out much of their earnings to shareholders. Leasing companies also tend to deliver great yields.

Now, in the crisis of 2008, these REITs with wings got killed. Capital was cheap before the crisis. Investors got very excited about the whole thing, and as usually happens in such cases, the deals got bubbly. A wave of REITs with wings went public in 2006 near the top of the market, and investors did poorly as markets cracked afterward. The initial valuations on the stocks were far too rich. The stocks traded for multiples of two times book and greater. Growth expectations were too high.

When these expectations were not met, the stocks fell big-time. But today?s valuations have gone too far the other way. They are very sober. The companies have also learned some things. They are more conservative in their structures, for example. It?s the usual boom and bust of markets that create and destroy opportunities.

All in all, I?m bullish on the industry. It?s a bet on two clear trends ? the rise of global passenger miles and the increasing popularity of leasing the planes.

L.A. Commercial Real Estate Financing Up 21%

Los Angeles, CA (PRWEB) July 24, 2012

After three quarters, Los Angeles area commercial real estate financing utilizing the SBA-504 loan program continues to show improvement over last year, according to CDC Small Business Finance.

CDC reported that SBA-504 loan financing approved through June 30 reached $ 738 million, up from $ 606 million for the same nine-month period a year ago. SBAs fiscal year runs from Oct. 1 to Sept. 30.

Were encouraged by the overall increase in activity through three quarters, said Dean Aloe, senior loan officer for CDC Small Business Finance. And more small businesses are taking advantage of the SBAs refinancing program before it expires in September.

Aloe said that $ 81 million of the $ 738 million in SBA-504 program financing was used to refinance properties.

The most active banks that partnered with CDCs on SBA-504 loans for the three-quarter period were Bank of America (60 loans, $ 115 million total financing), JP Morgan Chase (44 loans, $ 85 million total financing) and City National Bank (25 loans, $ 53 million total financing)

Over 2,900 new jobs are projected to be created in the Los Angeles region as a result of SBA-504 financing approved in the last nine months.

CDC Small Business Finance itself approved 120 SBA-504 loans in Los Angeles for the nine-month period, partnering with banks to provide $ 250 million in financing to area small businesses.

The SBA refinance program which ends this September is available to small businesses facing balloon payments on commercial property mortgages. The current refinance rate through this program is 4.66%.

The 504 loan program was created by the SBA for the specific purpose of financing long-term fixed assets such as commercial real estate and equipment with economic life of 10 years or greater.

DEAR DR. DONOHUE: I don?t understand how you can recommend birth-control pills for acne. Birth-control pills have been linked to blood clots, strokes and other life-threatening illnesses. Isn?t acne minor? Why complicate the issue with something that causes a worse problem? Also, in today?s health-conscious society, I am amazed that we have banned high-school boys from taking steroids, yet you and other doctors recommend steroids for high-school girls in the form of birth-control pills. This is an appalling double standard. ? M.W.

ANSWER: Your zeal is admirable. Your presentation of the facts isn?t. Millions of women have taken birth-control pills for the more than 50 years they?ve been available without grave danger to their health. A small number have experienced serious side effects, but no more so than with other medicines, including aspirin. The original birth-control pills had a higher concentration of estrogen than do today?s pills.

In German circumcision debate, 'us vs them' fears

BERLIN (AP) ? Rabbi David Goldberg had performed about 25 ritual circumcisions this year before a regional court ruled in June that the practice amounted to causing criminal bodily harm.

Despite the decision, he expects to perform the same number in second half of the year.

"I haven't changed anything," said Goldberg, one of Germany's few mohels ? a person trained in the Jewish ritual of circumcision.

Though the Cologne court's decision has raised fears among Muslims and Jews that circumcising their children could get them into legal trouble, it has had little practical effect in reducing religious circumcisions ? especially since the government has weighed in with assurances to both communities that their practices will be respected.

But both Jews and Muslims say that a more lasting effect may be "us vs. them" tensions that have raised an invisible barrier between secular Germans and religious minorities.

"It is no surprise that the Catholics and the Protestants have stood behind the Muslim community in this case and denounced the verdict," said Aiman Mazyek, the chairman of Germany's Central Council of Muslims. "In my opinion this is no picture of tolerance or religious freedom from a modern civilization. It is a step backward."

Jews are religiously required to circumcise baby boys on the 8th day after birth in a ceremony seen as their entrance into a covenant with God. Muslims also usually perform the procedure early in a boy's life, though sometimes wait until later in childhood.

In the Cologne decision, announced June 26, the court said circumcising young boys on religious grounds amounts to bodily harm even if parents consent to the procedure. The charge is punishable by anything from a fine to up to five years in prison.

The ruling came in the case of the circumcision of a 4-year-old Muslim boy that led to medical complications.

The boy was circumcised at the request of his parents. He developed complications two days later and was rushed to the hospital. Prosecutors charged the doctor, who was acquitted when a Cologne court found that he had performed the procedure properly, and that he had the parents' permission to carry out the circumcision.

But prosecutors appealed, and the higher Cologne court ruled that in a case of circumcision for non-medical reasons, the welfare of the child outweighed the religious rights of the parents. The acquittal of the doctor, however, was upheld because the court said the law had been unclear.

Though not precedent setting for other courts in Germany, the ruling prompted an outcry from Jewish and Muslim groups across Europe, while in Israel the German ambassador was invited to explain the decision to the Knesset.

Germany's main Catholic and Protestant organizations also condemned the ruling as an attack on religious freedom. The president of the German Medical Association said the ruling could even endanger children, by forcing circumcisions to be performed under possibly unsanitary conditions outside of hospitals.

Caught in the middle were people like Moishe Furer, a rabbinical student in Berlin whose son Elchanan was born five days before the decision was announced.

The native of Moldova said his own parents had to bribe a doctor when he was born to certify that his own circumcision was for medical purposes because performing the procedure for religious reasons was not allowed in the former Soviet Union. When he first heard of the Cologne decision, he said he thought the court ruling was being misinterpreted.

"We thought it was a mistake, that it could not be true that something like circumcision could be forbidden in Germany," he said.

But because of the religious significance, he said, they had the circumcision done, despite fears that other courts might follow the ruling even if it did not set a precedent.

"It was important enough to risk," he said.

The most disturbing part of the ruling for Jews and Muslims is the court's contention that being circumcised "runs contrary to the interest of the child to later choose his religious affiliation," said Josh Spinner, an American rabbi who grew up in Hamilton, Canada, and has been in Berlin for more than a decade.

"I'm a circumcised male, I expect that I have the right to become a Catholic or Protestant or Buddhist or atheist if I choose to today. But what the court is saying is that if I am circumcised I am a Jew," he said. "There's a very dark and very illiberal view of what this mark does on the individual."

Around 250,000 Jews live in Germany today, and about 4 million Muslims ? the largest minority among Germany's 82 million population.

Spinner said the ruling has the potential of opening the door to even greater restrictions on religious freedom for minorities ? a particularly sensitive issue in Germany given the years of state-imposed anti-Jewish measures under the Nazis that preceded the Holocaust.

"Germany needs to understand that if they want to tolerate Jews then they need to tolerate Judaism," Spinner said.

Chancellor Angela Merkel acknowledged the same concern behind closed doors in a meeting this week with her party leaders, saying "I don't want Germany to be the only country in the world in which Jews cannot perform their rituals," according to an official who was present.

Immediately following the court ruling, however, Foreign Minister Guido Westerwelle was alone among top officials to speak out on the issue. He offered assurances that "the free exercise of religion is protected in Germany ? that includes religious traditions."

In the past week, however, Merkel's spokesman Steffen Seibert has weighed in several times, promising that the government will come up with a solution that will allow the practice.

And in Parliament on Thursday, lawmakers from several parties adopted a resolution urging the government to draft a new law by the fall guaranteeing Muslims and Jews the right to continue circumcising their boys.

"Jewish and Muslim religious life must continue to be possible in Germany," the lawmakers said in the two-page resolution. "The circumcision of boys for Jews and Muslims has a central religious importance."

Had the government spoken out strongly sooner, said Goldberg, Germany may have managed to prevent the discussion from turning into an "us vs. them" embroilment.

"I get a lot of emails from non-Jewish Germans saying things like 'if you don't like it, leave Germany' ? very anti-Semitic. It's a bad atmosphere," said the rabbi, who immigrated to Germany 19 years ago from Israel and now lives in the southeastern city of Hof.

"Nobody said anything aside from Westerwelle, so that is also partially the fault of the government."

Joerg van Essen, parliamentary chief whip of the Free Democrats, Merkel's junior coalition partner, said that drafting the resolution to protect circumcisions took time because lawmakers needed to carefully balance constitutionally guaranteed religious freedoms and parental rights with the safety of the child.

"It's a relatively small procedure for the child, but banning it would be a big encroachment on religious freedom and the right of the parents to decide how to raise their children," he said.

Furer said he hoped that the circumcision debate would be expose more Germans to other religious ideas.

"I think a lot of Germans don't understand our religion and our religious issues," he said.
