Molecular mechanism links temperature with sex determination in some fish species

ScienceDaily (Dec. 29, 2011) ? A study led by the CSIC's Institute of Marine Sciences, in collaboration with researchers from the Centre for Genomic Regulation (CRG), has found the epigenetic mechanism that links temperature and gonadal sex in fish. High temperature increases DNA methylation of the gonadal aromatase promoter in female.

The environmental temperature has effects on sex determination. There are species, such as the Atlantic silverside fish, whose sex determination depends mainly on temperature. And there are other species whose sex determination is written within its DNA but still temperature can override this genetic 'instruction'.

Previous studies with the European sea bass, a fish whose sex determination depends on a combination of genetic and environmental factors, had shown that starting with a normal sex ratio population -equal proportions of male and females, it was possible to obtain an all-male group just through an increase in water temperature during a critical period of early development.

The most intriguing observation was that effects of temperature were maximum at a moment when gonads were not differentiated nor had they even started to form. Why was this happening, what makes temperature override the genetic component and so early was, until now, a long-standing puzzle.

Now, a research lead by the Spanish National Research Council (CSIC) has found out the answer. The team, lead by Francesc Piferrer, a CSIC professor at the Institute of Marine Sciences, in Barcelona, describes the mechanism which is induced by increased temperatures and triggers aromatase gene silencing.

Aromatase is an enzyme that transforms androgens into estrogens, which are essential for the development of ovaries in all non-mammalian vertebrates. If there is no aromatase there are no estrogens, and without estrogens the development of ovaries is not possible. The research, that has been realized with the contribution of the Center for Genomic Regulation, in Barcelona, is being published this week in PLos Genetics.

Early effects

In the experiment, scientists exposed two groups of European seabass larvae at different temperatures, normal and high temperature, during their first weeks of life.

Results show that high temperature increases the DNA methylation of the gonadal aromatase promoter (cyp19a), which, in turn drives its silencing as its transcriptional activation is inhibited. In the group exposed to high temperature there were genetic females that were only partially affected and yet developed as females. However, there were other genetic females with the highest level of DNA methylation that therefore developed as males because aromatase was fully inhibited.

This is the first time that an epigenetic mechanism linking an environmental factor to a cellular mechanism related to the sexual determination has been described in any animal. Previously, only a similar mechanism had been described in some plants.

As researcher Francesc Piferrer points out, 'animals are affected very soon, before differences between females and males become visible in histological samples, which happens on the 150th day of life, and even before the gonads start to form, which happens on the 35th day of life'.

This work explains why a few degrees of temperature rise masculinize these animals, something relevant in a context of global change.

It also explains why many fishes raised on farms are males, since farmers raise larvae in warmer waters in order to accelerate their growth. Piferrer adds that 'sex determination by temperature is very common in reptiles. It will be interesting to see if a similar mechanism to the one described exists in this group of vertebrates'.

R.I.P. Tarzan's Pal Cheetah

One of the most famous animal actors in Hollywood history is gone.

Cheetah, said to be the chimpanzee sidekick from Tarzan films, died of kidney failure over the weekend at the Suncoast Primate Sanctuary in Palm Harbor, Florida. The Tampa Tribune reports that he was roughly 80 years old.

Hardly the only primate to take on the iconic role, Cheetah probably received the most exposure. He appeared in the 1932-1934 installments of the franchise, at the beginning of its heyday when Olympic swimmer Johnny Weissmuller took over the title role.

In addition to having the distinction of being famous, Cheetah's longevity was one of his greatest accomplishments. Suncoast outreach director Debbie Cobb noted that chimpanzees generally live between 35 to 45 years in captivity, and only 25 to 35 years in the wild.

She also spoke highly of his character.

"He was very compassionate," Cobb told the Tampa Tribune. "He could tell if I was having a good day or a bad day. He was always trying to get me to laugh if he thought I was having a bad day. He was very in tune to human feelings."

Cheetah moved to the sanctuary around 1960, where he remained the most famous of its primate residents until his death. His interests included finger-painting, watching football and nondenominational Christian music.

Among Cheetah's Tarzan features were Tarzan and His Mate and Tarzan the Ape Man, where he starred alongside Weissmuller and Maureen O'Sullivan, who played "Jane."

O?Sullivan?s daughter, actress Mia Farrow, reacted to Cheetah's passing on her Twitter account, painting a less flattering portrait than Cobb.

"My mom, Tarzan's Jane, referred to Cheetah-the-chimp as 'that bastard,'" she wrote, "saying he bit her at every opportunity."

Games Like Call of Duty Could Save Troop Lives Says UK Military Advisor - News

A British government advisor has warned that unless the Ministry of Defence and arms of the military make better combat simulations, they?re going to be left behind by commercial titles such as Call of Duty and Battlefield.

Andrew Poulter, the technical team leader at MoD's Defence Science and Technology Laboratory in Portsdown has stated that, ?Back in the 1980s and 1990s, defence was far out in front in terms of quality of simulation.

"Military-built simulators were state of the art. But now, for ?50, you can buy a commercial game that will be far more realistic than the sorts of tools we were using. The truth is, the total spending on games development across the industry will be greater than spending on defence."

One the reasons for this is that new recruits, used to Xbox 360, PC and PS3 titles are simply not taking the old fashioned MOD training sims seriously.

The Guardian reports that, ?Troops are so used to playing high-quality commercial games set in combat zones that they tend to lose concentration unless the MoD simulations look equally realistic.?

Mr Poulter further points out that, ?Certainly, there is a level of computer games experience in recruits. So, the plots have to be realistic and the image generation has to be high quality. A lot of the older systems can be very clunky. If you put someone behind a block display, it is harder for them to be completely immersed."

He and his team are now working on new sims, "The weapons need to be credible,? he says. ?If they fire a rifle and the bullet travels three and a half miles, then that is not right. If they are steering a vehicle, then that has to be right too. Realism is more important than entertainment. Levels of immersion are very important."

Why is this important? According to Poulter, a commander who had seen troops in Afghanistan who had trained on a sim called Virtual Battlespace2, was sure that this had ?saved their lives when they came under fire.?

Obviously, maintaining concentration and adding the realism of weapons use from the MOD to the graphical realism of EA and Activision titles would only add to this.

(AP) ? Michele Bachmann's struggling presidential campaign saw her Iowa chairman defect Wednesday to rival Ron Paul's side, an embarrassing blow that came as some called for her to leave the race to free up her supporters for other candidates.

Hours after appearing with Bachmann at an event, state Sen. Kent Sorenson gave his endorsement to the Texas congressman at a Des Moines rally. Sorenson said he resigned from Bachmann's campaign to back Paul, whom he called the most conservative of the top-tier candidates.

Bachmann said Sorenson made the jump after "he was offered a large sum of money to go to work for the Paul campaign."

"Kent said to me yesterday that 'everyone sells out in Iowa, why shouldn't I,'" Bachmann said in a written statement. "Then he told me he would stay with our campaign. The Ron Paul campaign has to answer for its actions."

Paul campaign chairman Jesse Benton said the campaign was not paying Sorenson and that he was puzzled why Bachmann would make such a claim against an elected official popular with Iowa conservatives.

"We've always known Michele to be an honorable person. She should stop slandering an honorable Iowa state senator," Benton said.

Benton said Paul campaign officials had been begun speaking to Sorenson "in earnest" in the last few days, and that he had informed the campaign Wednesday he was ready to sign on.

Sorenson announced the switch during a Paul veterans rally in Des Moines. He didn't immediately return a phone call from The Associated Press to address Bachmann's charges that the move was financially based.

"The fact is, there is a clear top tier in the race for the Republican nomination for president, both here in Iowa and nationally. Ron Paul is easily the most conservative of this group," Sorenson said in a statement. "The truth is, it was an excruciatingly difficult decision for me to decide between supporting Michele Bachmann and Ron Paul at the beginning of this campaign."

Susan Geddes, a veteran operative in conservative GOP political circles who managed Sorenson's 2008 and 2010 legislative races, said Sorenson had told her several times, as recently as last month, that the Paul campaign had offered him money to leave Bachmann's campaign for the Texas congressman's.

Geddes said Sorenson had damaged his political future in Iowa by abandoning Bachmann's campaign less than a week before the caucuses.

"He just committed political suicide," she said.

Bachmann has been on a frantic 99-county push across Iowa in an effort to recover from the slide that followed her Iowa straw poll victory in August. Paul was a close second in that contest.

Earlier in the day, two influential pastors said they wanted either her or former Pennsylvania Sen. Rick Santorum to drop out of the running to keep evangelical voters from splitting their support. Bachmann insisted she would see the Iowa caucus campaign through.

Sorenson, who has strong ties to Iowa's tea party, was one of Bachmann's earliest public supporters and joined her for an afternoon stop at a Pizza Ranch restaurant in Indianola. Standing by her side, he declined to speak to the crowd there, citing numbness from dental work.

All day, Bachmann bashed Paul as "dangerous" for having a hands-off foreign policy. It was part of a double-barreled attack on the two Texans in the race. She went after Gov. Rick Perry for "27 years as a political insider."

The aggressive tone underscored Bachmann's role as a chaser in the final week of campaigning. She has bet heavily on Iowa, where she was born.

Bachmann came hardest at Perry, who this week began a television ad lumping Bachmann with other Washington figures seeking the GOP nomination in his attempt to come off as the outsider in the race.

"Just because he's held office outside of Washington, D.C., does not mean he is not a political insider. It's what you do in your office that matters," she said outside a small-town cafe. "There aren't very many politicians who have spent more time paying off political donors than Gov. Rick Perry has."

Perry has served Texas as a legislator, agriculture commissioner, lieutenant governor and governor.

Bachmann also said Perry has engaged in "crony capitalism" by helping donors with Texas government contracts or giving them political appointments. And she called Perry a double-dipper for collecting his gubernatorial salary and state pension at the same time.

Campaigning in Indianola on Wednesday, Perry scored what appeared to be a double hit of his own. Although he didn't name his targets, he took aim at lawmakers who sound off in Washington without much influence on policy ? a rap sometimes attached to Bachmann and Paul.

"Some campaigns are about their voting record, on bills that never make it to the president's desk. I'm campaigning on ideas that I've signed into law," Perry said.

As for Paul, Bachmann criticized him as misguided about foreign threats to U.S. interests.

"Ron Paul would be a dangerous president," Perry said. "He would have us ignore all of the warning signs of another brutal dictator who wants to wipe Israel off the face of the earth. I won't. He would wait until one of our cities is wiped off of the map until he reacted. I won't wait."

On Wednesday, former House Speaker Newt Gingrich told CNN that he would find it personally difficult to vote for Paul if the Texas congressman were to become the party's choice to go up against President Barack Obama next fall. Bachmann refused to go that far, dodging two direct questions about her willingness to back Paul later on.

"He won't win the nomination," she said.

At stop after stop, Bachmann cast herself as America's "Iron Lady," the nickname assigned to former British Prime Minister Margaret Thatcher. Bachmann sits on the House Intelligence Committee, which she said gives her a firm grip on world affairs.

State Sen. Brad Zaun, who had been Bachmann's Iowa co-chairman, was named full chairman after Sorenson's resignation.

Rooney Mara and Michael Sheen Reveal Details of Terrence Malick's Next Projects

Terrence Malick has three movies in the works, and the timeline on when each will be shot/released is fuzzy.? The untitled romantic drama starring Ben Affleck and Rachel McAdams is up first, though we don?t know release date (or even year) yet.? We have seen Malick filming Christian Bale for Knight of Cups and working with Ryan Gosling and Rooney Mara for Lawless, but international distributor FilmNation announced these two films will shoot back to back in 2012.? Mara clarified the picture in a recent interview:

?[Lawless is] something that I hope to do, but it?s unfortunately not until September, so it?s a ways away.?

That timeline implies the plan is to shoot Knight of Cups earlier in the year, followed by production on Lawless.? Given how much time Malick generally spends in post-production, I imagine the director will spend a lot of 2012 in the editing room for the Affleck/McAdams drama.? The Tree of Life ended up in theaters a year and a half after the initially announced Christmas 2009 release date.? I expect similar delays for at least one of these projects.? More after the jump.

Michael Sheen TRON: LEGACY PremiereIn other Malick news, Michael Sheen revealed to Mark Kermode and Simon Mayo [via The Playlist] that he shot a scene for the untitled drama:

?My girlfriend [McAdams] was in a film that Terrence Malick did so I went to visit her on set, and apparently, if you?re an actor and you turn up on a Terrence Malick set, he asks you to be in his film. So I got to be Ben Affleck?s boss for a day.?

Sheen is a nice addition to the already great cast of Affleck, McAdams, Olga Kurylenko, Javier Bardem, Rachel Weisz, Barry Pepper, and Jessica Chastain.? Neat insight into Malick?s process, too.? The director is known for removing characters in post-productions: Billy Bob Thornton, Martin Sheen, Gary Oldman, Bill Pullman, Lukas Haas, Jason Patric, Viggo Mortensen, and Mickey Rourke all shot scenes for The Thin Red Line that were edited out by the final cut.? Sheen?s role sounds like a very good candidate for the cutting room floor, but we?ll see.

So there you go.? No big revelations, but a bit of context and texture for Malick?s upcoming slate.

"We were able to look at an MRI, and it appears as though he has a groin injury that?s severe enough to require surgery," Dr. Amann told WWE.com. "Fortunately for Alberto, the surgery is minimally invasive and the recovery time is usually four to six weeks."

Head of Darfur's JEM dead, Sudan says (Reuters)

KHARTOUM (Reuters) ? Sudan's armed forces have killed the leader of Darfur's most powerful rebel group, state media said on Sunday, dealing a severe blow to insurgents in the remote western region in their nearly decade-long war with Khartoum.

The Darfur conflict has rumbled on since mainly non-Arab insurgents took up arms in 2003, saying the central government had left them out of the political and economic power structure and was favoring local Arab tribes.

Khalil Ibrahim, head of the Justice and Equality Movement (JEM), emerged as one of the most powerful rebel commanders. In 2008, his group launched a shock attack on Khartoum that killed more than 200 people.

Sudan's authorities have long hunted the leader, who had taken refuge in neighboring Libya under Muammar Gaddafi until the leader's overthrow deprived him of his safe haven.

Al-Sawarmi Khalid, Sudan's armed forces spokesman, said Ibrahim had been killed early on Sunday morning while trying to cross into South Sudan, which seceded in July under a 2005 peace deal that ended a separate, decades-long civil war.

"The armed forces clashed in a direct confrontation with Khalil Ibrahim's rebel forces, and were able to eliminate Khalil Ibrahim," Khalid told state television.

JEM's spokesman could not immediately be reached for comment on Sunday, but Al Jazeera television quoted Ibrahim's brother as confirming the death, saying he died in an air raid on his military convoy.

The death of Ibrahim - often described as commanding and charismatic - could be a major blow to JEM, although tightly restricted access to Sudan's conflict zones has made it hard to gauge the actual strength and internal unity of insurgents.

In November, JEM said it had formed an alliance with other insurgents in Darfur and in two of Sudan's conflict-stricken border states where fighting broke out around the time of South Sudan's secession.

Analysts have questioned how effective the alliance would be, given that Darfur's various rebel factions have rarely been able to sustain long-term military and political coordination.

LIBYAN REFUGE

The United Nations has said as many as 300,000 people may have died in Darfur, where Khartoum mobilized troops and mostly Arab militias to crush the uprising. Khartoum puts the death toll at 10,000.

The International Criminal Court has charged Sudan's President Omar al-Bashir with masterminding genocide and other crimes in the region, a charge Khartoum dismisses as political.

While violence has died down since the mass killings reported in the early days of the conflict, law and order have collapsed and the area has been hit by attacks by bandits, militias, soldiers and tribal groups in recent years.

Various rebel groups, including two factions of the Sudan Liberation Army (SLA), have fought on, even as Qatar brokered a peace deal which Sudan signed with the Liberation and Justice Movement (LJM), an umbrella association of smaller groups.

The major rebel groups, including JEM, have refused to sign the document, dampening hopes the region will soon see peace.

JEM said on Saturday its fighters had clashed with government militias in parts of the North Kordofan state and were planning to advance on the capital Khartoum to overthrow Bashir's government.

Mexico extradites suspect in Brownsville ICE agent's murder


A Zetas drug cartel member accused of killing a Brownsville ICE agent in Mexico is now in American custody where he faced a judge in Washington DC.

Mexican authorities have extradited Julian Espinoza-Zapata to the United States where he?s facing a four-count federal indictment.

Espinoza-Zapata,? aka ?El Piolin,? is accused of the murder of U.S. Immigration & Customs Enforcement (ICE) agent Jaime Zapata.

The alleged Zetas member is also accused of the attempted murder of ICE agent Victor Avila.

The two ICE agents were attacked by gunmen in San Luis Potosi back in February.

Mexican authorities arrested Espinoza-Zapata and several other suspects as part of an ongoing investigation.

Espinoza-Zapata has now been extradited and appeared before U.S. District Chief Judge Royce Lamberth in Washington DC on Wednesday morning.

Chief Judge Lamberth unsealed the four-page indictment against Espinoza-Zapata and ordered that he be held without bail.

Espinoza-Zapata is the only person listed on the indictment. His next court appearance is scheduled for January 25th 2012.

New technique makes it easier to etch semiconductors

Creating semiconductor structures for high-end optoelectronic devices just got easier, thanks to University of Illinois researchers.

The team developed a method to chemically etch patterned arrays in the semiconductor gallium arsenide, used in solar cells, lasers, light emitting diodes (LEDs), field effect transistors (FETs), capacitors and sensors. Led by electrical and computer engineering professor Xiuling Li, the researchers describe their technique in the journal Nano Letters.

A semiconductor's physical properties can vary depending on its structure, so semiconductor wafers are etched into structures that tune their electrical and optical properties and connectivity before they are assembled into chips.

Semiconductors are commonly etched with two techniques: "Wet" etching uses a chemical solution to erode the semiconductor in all directions, while "dry" etching uses a directed beam of ions to bombard the surface, carving out a directed pattern. Such patterns are required for high-aspect-ratio nanostructures, or tiny shapes that have a large ratio of height to width. High-aspect-ratio structures are essential to many high-end optoelectronic device applications.

While silicon is the most ubiquitous material in semiconductor devices, materials in the III-V (pronounced three-five) group are more efficient in optoelectronic applications, such as solar cells or lasers.

Unfortunately, these materials can be difficult to dry etch, as the high-energy ion blasts damage the semiconductor's surface. III-V semiconductors are especially susceptible to damage.

To address this problem, Li and her group turned to metal-assisted chemical etching (MacEtch), a wet-etching approach they had previously developed for silicon. Unlike other wet methods, MacEtch works in one direction, from the top down. It is faster and less expensive than many dry etch techniques, according to Li. Her group revisited the MacEtch technique, optimizing the chemical solution and reaction conditions for the III-V semiconductor gallium arsenide (GaAs).

The process has two steps. First, a thin film of metal is patterned on the GaAs surface. Then, the semiconductor with the metal pattern is immersed in the MacEtch chemical solution. The metal catalyzes the reaction so that only the areas touching metal are etched away, and high-aspect-ratio structures are formed as the metal sinks into the wafer. When the etching is done, the metal can be cleaned from the surface without damaging it.

"It is a big deal to be able to etch GaAs this way," Li said. "The realization of high-aspect-ratio III-V nanostructure arrays by wet etching can potentially transform the fabrication of semiconductor lasers where surface grating is currently fabricated by dry etching, which is expensive and causes surface damage."

To create metal film patterns on the GaAs surface, Li's team used a patterning technique pioneered by John Rogers, the Lee J. Flory-Founder Chair and a professor of materials science and engineering at the U. of I. Their research teams joined forces to optimize the method, called soft lithography, for chemical compatibility while protecting the GaAs surface. Soft lithography is applied to the whole semiconductor wafer, as opposed to small segments, creating patterns over large areas ? without expensive optical equipment.

"The combination of soft lithography and MacEtch make the perfect combination to produce large-area, high-aspect-ratio III-V nanostructures in a low-cost fashion," said Li, who is affiliated with the Micro and Nanotechnology Laboratory, the Frederick Seitz Materials Research Laboratory and the Beckman Institute for Advanced Science and Technology at the U. of I.

Next, the researchers hope to further optimize conditions for GaAs etching and establish parameters for MacEtch of other III-V semiconductors. Then, they hope to demonstrate device fabrication, including distributed Bragg reflector lasers and photonic crystals.

"MacEtch is a universal method as long as the right condition for deferential etching with and without metal can be found," Li said.

Being a mosquito can really suck. Not only do you have to gulp down your food because your dinner can turn around and swat you if you?re not fast enough, but a bellyful of hot blood can really do a number on your little body, which prefers to keep things cool.

So how do feeding skeeters keep from overheating? They take advantage of evaporation. That?s according to a study in the journal Current Biology. [Chlo? Lahond?re and Claudio R. Lazzari, Mosquitoes Cool Down during Blood Feeding to Avoid Overheating]

Insects depend on the environment to regulate their body temperatures. But too much heat can be bad for their health. That?s a serious problem when your meals consist of hot, fresh animal blood. The solution, it seems, is to use a drop of your dinner to cool you down. Like sweat, only blood.

Scientists used a thermal camera to watch mosquitos eat. And they found that mosquitoes that excrete, and then hang onto, a single bead of blood while feeding have bodies a couple degrees cooler than those that don?t.

Disrupting this sacrificial blood cooling system could provide a new strategy for controlling mosquitoes, and the diseases they spread. Because if a skeeter can?t secrete, its next supper could be its last.

(AP) ? The fallout from the death of a Florida A&M University drum major broadened Wednesday to nearly two dozen high schools in Georgia, where marching band activities were suspended over concerns of "inappropriate physical activity" between band mates.

A metro Atlanta school district began investigating after Robert Champion died Nov. 19. The Southwest DeKalb High graduate was found unresponsive on a bus parked in front of an Orlando hotel after a university football game, and authorities said his death involved hazing.

Another Florida A&M student, Bria Shante Hunter, who also attended Southwest DeKalb, told police she was severely beaten in a hazing ritual about three weeks before Champion's death.

Hunter, a freshman and clarinet player, said she was repeatedly hit in her legs by members of the "Red Dawg Order," a band club for Georgia natives. Authorities have said Champion was hazed, but have not described how.

Three band members were arrested in Hunter's case and charged with hazing. Two were also charged with battery.

Meanwhile, Florida authorities looking into Champion's death opened a new investigation after they uncovered possible employee fraud and misconduct at the university, according to documents released Wednesday.

The separate investigation was triggered by information investigators discovered regarding the finances of the Marching 100, according to a person in Gov. Rick Scott's administration. He asked for anonymity because he was not publicly authorized to discuss the matter.

In Georgia, Walter Woods, spokesman for the DeKalb County school district, said they were investigating marching bands at the district's 21 high schools after two problems over the summer. He declined to say whether the incidences involved hazing and said the students involved were not injured.

"Our interest is in protecting students, the safety of the students," said Woods. "We have notified schools to be vigilant of our existing policy, which is zero tolerance for harassment of any kind."

The bands' busy season ended last week with the conclusion of football season, but the Atlanta-area bands will still be able to perform in the Martin Luther King Day parade in Stone Mountain in January, Woods said. No marching bands are scheduled to perform in a football bowl game.

Decatur resident Keith Sailor, who is the president of the marching band booster club at Southwest DeKalb High School, said his son, a sophomore, has never had any problems with hazing.

"I'm pretty comfortable with him participating in the band," he said, declining further comment.

Experts say hazing has been found in students as young as 12, particularly when it involves a team activity like sports or band. Richard Sigal, a retired New Jersey sociology professor and expert on hazing, said schools need to examine whether it is happening.

"I think anytime you get a group of young people together, at some point, a tradition becomes established and that's what perpetuates hazing," Sigal said. "It's up to coaches, it's up to the principals, it's up to the band leaders to stop it."

In Florida, the state law enforcement agency sent letters to the head of the FAMU board and the head of the state university system, but they did not detail the potential fraud or misconduct, saying only that it involves school employees as well as "persons associated" with the university.

The school's president, James Ammons was hired more than four years ago as part of an effort to clear up past problems at the university. State audits found that some financial records could not be verified and there was questionable contracting. The college also could not account for millions of dollars in inventory.

Last week, the school's board of trustees publicly reprimanded Ammons after a contentious debate on whether he should have been placed on leave.

Solomon Badger, chairman of the FAMU board, said the university would cooperate with the new investigation.

"I didn't know anything about the fraud and I still don't," Badger said.

University officials have suspended the famed Marching 100 band from performances until the investigation into Champion's death is completed.

Europe crisis "serious risk" to outlook: Treasury (Reuters)

WASHINGTON (Reuters) ? Europe's debt crisis has deepened and become more entrenched, posing a serious risk to the economic outlook, a senior Treasury official told lawmakers on Friday.

Mark Sobel, Treasury deputy assistant secretary for international affairs, said in prepared testimony before the House of Representatives Oversight subcommittee that the crisis has sharply weakened Europe's economic prospects for next year.

"Growth in the euro area is projected by most analysts to be negative this quarter and into early 2012, with weak growth persisting in 2012," Sobel said.

He added that Europe's problems were a "serious risk for the U.S. economic outlook and said that President Barack Obama and Treasury Secretary Timothy Geithner were "actively engaged" with European counterparts to help them deal with the crisis.

Sobel also repeated Obama administration's views that stronger European countries must do more to contain the crisis on their own.

"As European countries act to develop critical economic reforms and to strengthen fiscal governance, Europe must also continue mobilizing the requisite resources to put in place a strong and credible firewall commensurate with the scale of the challenge," he said. It must do so quickly, with force and determination."

While the International Monetary Fund can play a role in easing the crisis, "the IMF cannot substitute for a strong and credible European firewall and response," he added.

Morgan Stanley settles with MBIA, sets $1.8 billion charge (Reuters)

(Reuters) ? Morgan Stanley (MS.N) agreed to give up insurance claims against MBIA Inc (MBI.N) in exchange for a $1.1 billion payment from the ailing insurer, ending a two-year legal fight over guarantees on mortgage bonds.

The deal, announced on Tuesday, is the latest move by Morgan Stanley Chief Executive James Gorman to clear away vestiges of the financial crisis and put the Wall Street bank on a more stable path.

The settlement will cause Morgan Stanley to take a $1.2 billion charge in the fourth quarter after accounting for a tax benefit, but it will also remove risky assets from company's balance sheet that have led to big swings in its quarterly earnings over the past four years.

Additionally, the deal will shore up Morgan Stanley's capital levels under tougher rules that start coming into effect in 2013.

In a statement, Gorman said the settlement had been a "top priority" for Morgan Stanley this year, "consistent with our efforts to build capital and de-risk the balance sheet."

The settlement stems from credit-default swaps (CDS) that Morgan Stanley had entered with MBIA several years ago to protect against losses on mortgage bonds.

MBIA, a bond insurer, historically focused on municipal bonds but as the U.S. real-estate market heated up last decade, it sold large numbers of CDS on mortgage-backed securities and other structured finance products.

MBIA's bets on CDS started souring as the financial crisis ramped up, forcing regulators to split the insurer into a municipal guarantee business and a structured finance unit.

A group of 18 banks, including Morgan Stanley, objected to the restructuring in court, arguing that it might leave the insurer unable to pay out its structured finance obligations.

As part of the settlement, Morgan Stanley agreed to end its legal objections to MBIA's restructuring, and MBIA agreed to drop a lawsuit pertaining to the quality of the bonds underlying the CDS contracts.

MBIA will pay Morgan Stanley $1.1 billion to settle legal claims, a person familiar with the matter told Reuters.

The insurer's structured finance division, known as MBIA Insurance, will pay the settlement using a loan from its municipal bond division called National Finance, according to another person familiar with the deal.

All but five banks have settled with MBIA, including HSBC Holdings PLC (HSBA.L), Royal Bank of Scotland PLC (RBS.L) and Wells Fargo & Co (WFC.N). Those still pursuing claims include Bank of America Corp (BAC.N) and UBS AG (UBSN.VX).

An MBIA spokesman confirmed that there was a settlement with Morgan Stanley, but declined to comment on the $1.1 billion settlement figure.

"We are continuing to work toward resolving all the litigation," said Kevin Brown, a spokesman for MBIA. "We're talking to most, but not all, the parties."

Robert Giuffra Jr, a partner at Sullivan & Cromwell and lead counsel for banks that are still suing MBIA, said the plaintiffs will continue to fight its restructuring.

Benjamin Lawsky, financial services superintendent for the state of New York, said his agency will continue to work with the remaining companies and MBIA to seek resolutions.

A WIN FOR BOTH SIDES

The Morgan Stanley-MBIA settlement will benefit both parties, investors said, though it may represent a bigger win for MBIA.

MBIA shares closed up 0.7 percent on Tuesday at $11.48, having hit $12.60 after the deal announcement. Morgan Stanley fell 1.4 percent to end the day at $15.17, but had risen as high as $16.55 earlier in the day.

The settlement will remove a big swing factor from Morgan Stanley's quarterly earnings results. Because the CDS contracts turned MBIA into a major counterparty of the bank, the widening or narrowing of its credit spreads resulted in big non-cash losses and gains.

Getting rid of MBIA exposure will free up $5 billion worth of capital for Morgan Stanley and improve its Tier 1 common capital ratio by 75 basis points under upcoming rules. Under existing rules, it will reduce Morgan Stanley's Tier 1 common ratio by 30 basis points.

Gorman has been on a mission to improve Morgan Stanley's balance sheet this year, in part to ease investor concerns about the bank's exposure to the European sovereign debt crisis.

In April, Gorman struck a deal with Mitsubishi UFJ Financial Group, a major investor and partner, to convert 7.8 million Morgan Stanley preferred shares into 385.5 million shares of common stock. That move lifted Morgan Stanley's capital ratios.

Gorman has also overseen the dismantling of risky trading operations to comply with a new financial reform rule, wound down other risky assets and implemented higher pricing for over-the-counter derivatives products to reflect higher risk and cost. He has also adjusted Morgan Stanley's funding model to reduce its exposure to riskier, short-term lending.

Still, its shares are down 43 percent so far this year, compared with a 32 percent decline for the NYSE Arca Securities Broker/Dealer Index.

Walter Todd, a portfolio manager at Greenwood Capital, said Gorman's efforts have been noticed but that concerns remain over Europe and the business model of large investment banks. Todd exited his firm's Morgan Stanley position last week to reduce volatility in the portfolio.

"I think it's nice to get this behind them and check it off as something not to worry about anymore , but I wouldn't go out and buy the name because of this agreement," he said.

For MBIA's part, the deal removes a big hurdle standing in the way of its restructuring, at a lower cost than if Morgan Stanley had pursued its claims in full.

Morgan Stanley had $2.7 billion worth of net exposure to MBIA's derivative contracts as of September 30, according to a quarterly regulatory filing. The bank is writing off $1.8 billion worth of the underlying debt, which will lead to the $1.2 billion charge after taxes.

But Manal Mehta, a founding partner of the hedge fund Branch Hill Capital, which owns MBIA shares, estimates that the total notional amount of the underlying securities was more than $10 billion -- meaning that MBIA's $1.1 billion settlement may represent just 10 percent of the potential cost.

"This is a fantastic deal for MBIA," said Mehta.

A Morgan Stanley spokesman declined to disclose the notional amount of underlying securities. Mehta extrapolated his estimate from disclosures by Bank of America.
